The SAFETY Act is a powerful law enacted by the U.S. Congress in the wake of the horrific terrorist attacks of 9/11. The SAFETY Act provides companies critical third-party liability protections for claims arising out of an act of terrorism. To achieve SAFETY Act, companies must demonstrate to the U.S. Department of Homeland Security that they deploy a security program for its venue that is effective at either detecting, deterring, and/or mitigating acts of terrorism. This panel will discuss the potential third-party liability that companies and executives could face following an act of terrorism and how a company can pursue the SAFETY Act protections.
